Welcome to MyBizC. These Terms and Conditions ("Terms") are a legally binding agreement between you ("User," "you," or "your") and MyBizC Private Limited ("MyBizC," "we," "us," or "our"), governing your access to and use of our website at mybizc.com and all related services (collectively, the "Service" or "Platform").
By accessing or using our Platform — including creating an account, purchasing a subscription, or simply browsing the website — you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Refund & Cancellation Policy, which are incorporated herein by reference.
If you do not agree to these Terms, please do not access or use our Platform.

Eligibility
By accessing the Platform, you represent and warrant that you are at least 18 years of age and have the full legal capacity to enter into binding contracts. If you are accessing the Platform on behalf of a business, partnership, or other organisation, you represent that you have the authority to bind that entity to these Terms, and references to "you" include that entity.
Permitted Use
You may use the Platform for lawful purposes and only in accordance with these Terms. You agree not to:
- Use the Platform for any illegal, fraudulent, or unauthorised purpose.
- Upload, transmit, or share content that is defamatory, harassing, obscene, sexually explicit, or otherwise objectionable.
- Interfere with or disrupt the functioning, security, or integrity of the Platform or servers.
- Attempt to gain unauthorised access to any part of the Platform, other user accounts, or connected systems.
- Use automated means (bots, scrapers, crawlers) to access the Platform without our prior written permission.
- Sell, resell, or sublicense access to the Platform or any part of it without our express written consent.
- Violate any applicable local, state, national, or international law or regulation.
- Impersonate any person or entity or falsely represent your affiliation with any person or entity.
Merchant Onboarding
MyBizC retains sole discretion in determining whether to onboard or reject any Merchant on the Platform. We may evaluate factors including but not limited to: the nature of the business, product offerings, compliance history, and potential impact on other users.
Our decision to onboard or reject a Merchant is final and is not subject to appeal or dispute. We may revise our onboarding criteria at any time without notice.

Prohibited Business Categories
The following are not permitted on MyBizC: illegal goods or services, tobacco, alcohol (without proper licensing), adult content, weapons, gambling, multi-level marketing schemes, and any business that violates Indian law. Violation may result in immediate account termination without refund.
Ownership of Platform Content
The Platform and its contents — including but not limited to text, graphics, logos, images, icons, button designs, software code, database structures, and the overall look and feel — are the exclusive property of MyBizC Private Limited and/or its licensors, and are protected under applicable intellectual property laws including the Copyright Act, 1957 and the Trade Marks Act, 1999 of India.
Restrictions on Use
You may not, without our prior written permission:
- Reproduce, copy, distribute, or create derivative works based on any part of the Platform.
- Use any data mining, scraping, crawling, or similar data-gathering techniques on the Platform.
- Frame or mirror any content from the Platform on any other website or server.
- Reverse engineer, decompile, or disassemble any software or algorithms used in the Platform.
Trademarks
"MyBizC," the MyBizC logo, and all related names, logos, product names, and design marks are trademarks or registered trademarks of MyBizC Private Limited. You may not use these marks without our prior written consent in any circumstance.
Licence to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your own lawful business purposes. This licence does not include the right to sublicense, sell, or commercially exploit the Platform or its content.

AI-Generated Content
Content generated by MyBizC's AI tools (product descriptions, social media posts, etc.) is licensed to you for use in connection with your MyBizC store. You may not use AI-generated content from MyBizC to train competing AI models or for purposes unrelated to your business on the Platform.
The Platform allows you to upload, publish, or share Content including product images, descriptions, business information, reviews, and other materials. You are solely responsible for all Content you submit to the Platform.
Your Warranties Regarding Content
By submitting Content to the Platform, you represent and warrant that:
- You own the Content or have the necessary rights, licences, and permissions to use and share it.
- The Content does not infringe any copyright, trademark, trade secret, privacy, or other intellectual property or legal rights of any third party.
- The Content is not false, misleading, defamatory, harassing, obscene, sexually explicit, hateful, or otherwise objectionable.
- The Content complies with all applicable laws and regulations.
- The Content does not contain malware, viruses, or any harmful code.
Licence You Grant Us
By submitting Content to the Platform, you grant MyBizC a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide licence to use, reproduce, modify, adapt, publish, translate, distribute, and display that Content in connection with providing and promoting the Platform and its services.
This licence includes the right to use your business name and store in our marketing materials, case studies, and promotional content. You may request removal from such materials by contacting [email protected].

Zero-Tolerance Policy
MyBizC maintains a zero-tolerance policy for objectionable, illegal, or harmful Content. Any Content deemed to violate these Terms will be removed immediately without prior notice. Users responsible for such Content may face permanent account suspension and may be reported to relevant authorities where required by law.
The Platform may contain links to or integrations with third-party websites, applications, and services (such as Razorpay, Shiprocket, Instagram, Google Maps, WhatsApp, and others). These third-party services are not owned or controlled by MyBizC.
- We do not endorse, recommend, or assume any responsibility for the content, privacy policies, practices, or availability of any third-party website or service.
- Your access to and use of third-party services is entirely at your own risk and subject to those services' own terms and conditions.
- We are not liable for any loss or damage caused by your reliance on or use of any third-party content, products, or services accessible through the Platform.
- Third-party payment processing (Razorpay) is governed by Razorpay's own Terms of Service and Privacy Policy. MyBizC does not store, process, or have access to your payment card details.

Third-Party Integrations
When you connect third-party services to your MyBizC store (e.g., social media accounts, marketplaces), you are responsible for complying with those platforms' own terms of service. MyBizC is not responsible for actions taken by third-party platforms in relation to your connected accounts.
Disclaimer of Warranties
The Platform and all content, services, and features are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. MyBizC expressly disclaims all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any information on the Platform.
Limitation of Liability
To the fullest extent permitted by applicable law, MyBizC Private Limited, including its officers, directors, employees, agents, and affiliates, shall not be liable for any:
- Direct, indirect, incidental, special, consequential, or punitive damages of any kind.
- Loss of profits, revenue, business, data, goodwill, or other intangible losses.
- Damages arising from your access to, use of, or inability to access or use the Platform or Service.
- Damages arising from conduct or content of any third party on the Platform.
- Damages arising from unauthorised access, use, or alteration of your transmissions or content.
This limitation applies regardless of whether the claim is based on warranty, contract, tort (including negligence), statute, or any other legal theory — and whether or not MyBizC has been advised of the possibility of such damages.

Maximum Liability Cap
In no event shall MyBizC's total cumulative liability to you for all claims arising out of or relating to these Terms or the Platform exceed the amount you paid to MyBizC in the 12 months immediately preceding the claim, or ₹5,000 — whichever is greater.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we collect, use, store, and protect your personal information.
Data Deletion Requests
You have the right to request the deletion of your personal data. Upon receiving a verified deletion request, MyBizC will:
- Acknowledge your request within 3 business days.
- Complete the data deletion process within 30 days of the request, subject to legal, regulatory, or operational obligations that may require retention.
- Notify you in writing if data deletion cannot be completed and provide the reason for retention.

Data Rectification
You have the right to request correction or update of your personal data if it is inaccurate or incomplete. MyBizC will respond to rectification requests within 3 business days and complete the correction within 30 days. You will be notified once your data has been rectified.
Data Retention
MyBizC classifies data based on sensitivity and retains it for periods as outlined in our data retention policy. We conduct regular audits to ensure compliance with applicable legal and regulatory requirements. After account cancellation, your data is retained for 30 days before permanent deletion, except where retention is required by law.
Automated & Manual Review
MyBizC uses a combination of automated tools and manual review processes to monitor user-uploaded Content for compliance with our content policies. We strive to keep the Platform free from inappropriate, harmful, or illegal content.
While we make reasonable efforts to moderate content, we cannot review all content in real-time and are not responsible for Content posted by Users before it is reviewed.
Reporting Inappropriate Content
If you encounter Content on the Platform that you believe violates these Terms or is otherwise inappropriate, we encourage you to report it immediately to our support team at [email protected].
We will review reported Content promptly and take appropriate action, which may include:
- Removal or editing of the Content.
- Warning, suspension, or permanent termination of the responsible User's account.
- Reporting to law enforcement or relevant regulatory authorities, where required.

Our Commitment to a Safe Platform
We take content safety seriously. If you encounter any content that is illegal, harmful, or harassing on the Platform, please report it immediately. We aim to review all reports within 24 hours on business days.
You agree to indemnify, defend, and hold harmless MyBizC Private Limited and its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal and attorney's fees) arising out of or in connection with:
- Your access to or use of the Platform or Service.
- Your violation of any provision of these Terms.
- Your violation of any applicable law, rule, or regulation.
- Any Content you upload, submit, or share on the Platform.
- Your violation of any rights of any third party, including intellectual property, privacy, or contractual rights.
- Any dispute or claim between you and any third party arising from your use of the Platform.
MyBizC reserves the right to assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence of such claims. You will not settle any such claim without MyBizC's prior written consent.
Termination by MyBizC
MyBizC may, at its sole discretion, terminate or suspend your account and access to the Platform at any time, with or without notice, if we believe:
- You have violated these Terms or any of our policies.
- You have engaged in fraudulent, abusive, or illegal activity.
- Your conduct is harmful to other users, third parties, or MyBizC.
- Continued access poses a security or legal risk to the Platform.
Termination by You
You may terminate your account at any time by cancelling your subscription through your dashboard or by contacting our support team. Please refer to our Refund & Cancellation Policy for details on what happens to your data and any applicable refunds upon termination.
Effect of Termination
- Upon termination, your right to access the Platform ceases immediately.
- All licences granted to you under these Terms terminate immediately.
- MyBizC may delete your account, store, and all associated data after the data retention period (30 days post-cancellation).
- Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) shall continue to apply.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The Information Technology Act, 2000, the Consumer Protection Act, 2019, and other applicable Indian laws apply to your use of the Platform.
Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or in connection with these Terms or the Platform:
- Informal Resolution: The parties shall first attempt to resolve the dispute informally by contacting MyBizC support at [email protected]. We will attempt to resolve the matter within 30 days.
- Arbitration: If informal resolution fails, the dispute shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in Mumbai, Maharashtra, in the English language, by a single arbitrator mutually agreed upon by both parties.
- Courts: Notwithstanding the above, either party may seek urgent injunctive or other equitable relief from the courts of Mumbai, Maharashtra.
Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and MyBizC regarding the Platform and supersede all prior agreements, understandings, and representations, whether written or oral.

Jurisdiction
By using MyBizC, you consent to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India for any matters not subject to arbitration. If you are using the Platform from outside India, you are responsible for compliance with your local laws in addition to these Terms.
